Terms and Condition

Enhanced QR Code Reader for PAN Card is an application developed under instructions of NSDL e-Governance Infrastructure Limited (NSDL eGov) for reading information on PAN Card with the new QR Code feature.

NSDL e-Gov ("us", "we", or "our") operates the website www.tin-nsdl.com and manages the Enhanced QR Code Reader for PAN Card mobile application (herein after referred to as “the application").

These Terms and Conditions ("Terms", "Terms and Conditions") govern your relationship with the website www.tin-nsdl.com and the Enhanced QR Code Reader for PAN Card mobile application NSDL e-Gov.

Please read these Terms and Conditions carefully before using our website www.tin-nsdl.com and Enhanced QR Code Reader for PAN Card mobile application.

Your access to and use of the application is based on your acceptance of and compliance with these Terms and Conditions. These Terms apply to all visitors, users and others who access and/or use the application.

By accessing or using the application you agree to be bound by these Terms and Conditions and accept all legal consequences. If you do not agree to these Terms and Conditions, in whole or in part, please do not use the application.

Content

Our application allows you to read the Enhanced QR Code printed on PAN Card. The same is for verifying the details mentioned on the PAN Card and does not authenticate the same. You are refrained from taking screenshots, keeping the information stored in your phone or other communication devices. You represent and warrant that:

  • you will not indulge in any malpractices whatsoever
  • you will not reverse engineer the application
  • you will not abuse or misuse the services

We reserve all rights to remove the application at our sole discretion.

Accounts

There is no account created using the application. The application takes permission of Camera to read the QR code and display the information within the QR code to verify the same with information of the PAN Card holder. You agree not to disclose or misuse the information received after the QR Code is read by the application.

Intellectual Property

The application is developed for NSDL e-Governance Infrastructure Limited. The PAN Card information belongs to respective PAN holders and the PAN services is the Intellectual Property of Income Tax Department, Government of India. These Terms and Conditions do not grant you a license to use any trademark of NSDL e-Gov and/or Income Tax Department, Government of India.

Termination

We may terminate or suspend access to the application, without prior notice or liability, for any reason whatsoever, including, without limitations. All provisions of the Terms and Conditions shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability. Upon termination, your right to use the application will immediately cease. If you wish to avoid using the application, you may uninstall the application from your communication device.

Indemnification

You agree to indemnify, defend and hold harmless NSDL e-Governance Infrastructure Limited, its principals, officers, directors, representatives, employees, contractors, licensors, licensees, suppliers and agents, from and against any claims, losses, damages, losses, obligations, costs, actions or demands.

These include but are not limited to:

  • legal and accounting fees resulting from your use of the Service;
  • your breach of any of these Terms and Conditions;
  • any activity related to your use of the application.

This includes any negligent or illegal conduct by you, any person or entity accessing the application using your communication device whether such access is obtained via genuine, fraudulent or illegal means.

Limitation Of Liability

NSDL e-Governance Infrastructure Limited, its directors, employees, partners, agents, suppliers, or affiliates, shall not be liable for any loss or damage, direct or indirect, incidental, special, consequential or punitive damages, including without limitation, economic loss, loss or damage to electronic media or data, goodwill, or other intangible losses, resulting from

  • your access to or use of the application;
  • your inability to access or use the application
  • any conduct or content of any third-party on or related to the application
  • any content obtained from or through the application; and
  • the unauthorized access to, use of or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other claim in law, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Disclaimer And Non-Waiver of Rights

NSDL e-Governance Infrastructure Limited makes no guarantees, representations or warranties of any kind as regards the website and associated technology or application. Any purportedly applicable warranties, terms and conditions are excluded, to the fullest extent permitted by law.

Your use of the application is at your sole risk. The application is provided on an "AS IS" and "AS AVAILABLE" basis. The application is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance, except as provided for under the laws of India, subject to Mumbai Jurisdiction.

NSDL e-Gov its subsidiaries, affiliates, and its licensors do not warrant that

  • the application will function uninterrupted, secure or available at any particular time or location;
  • any errors or defects will be corrected;
  • the application is free of viruses or other harmful components; or
  • the results of using the application will meet your requirements.

If you breach any of these Terms and Conditions of NSDL e-Gov and if NSDL e-Governance Infrastructure Limited chooses not to immediately act, or chooses not to act at all, NSDL e-Gov will still be entitled to all rights and remedies at any later date, or in any other situation, where you breach these Terms and Conditions. NSDL e-Gov does not waive any of its rights. NSDL e-Governance shall not be responsible for any purported breach of these Terms and Conditions caused by circumstances beyond its control. A person who is not a party to these Terms and Conditions shall have no rights whatsoever of claim and/or enforcement.

You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.

Exclusions

As set out, above, some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you. Laws of Republic of India subject to Mumbai Jurisdiction will be applicable in such situations.

Governing Law

These Terms shall be governed by, and interpreted and enforced in accordance with, the laws of Republic of India subject to Mumbai Jurisdiction, as applicable.

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, then any remaining provisions of these Terms and Conditions will remain in effect. These Terms and Conditions constitute the entire agreement between us regarding our application, and supersede and replace any prior agreements, oral or otherwise, regarding the application.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions at any time.

By continuing to access or use our application after those modified/replaced Terms and Conditions become effective, you agree to be bound by the revised Terms and Conditions. If you do not agree to the new Terms and Conditions, in whole or in part, please stop using the application.
